JOB SUMMARY

Manages workers' compensation, auto, and general liability claims from receipt through settlement or litigation including: investigations, determination of liability, settlement negotiations/denials, and the proper management of documentation including private and protected information.

MINIMUM QUALIFICATIONS

Four (4) years of experience investigating, negotiating, and adjusting claims and claim settlements; of which two (2) years may be substituted for a degree in Business Management, Public Administration or other closely related field. Must possess current Residence Adjuster's License issued by the State of Utah or be able to obtain licensure within six (6) months of hire date. Due to the nature of this position, the successful applicant must successfully pass an initial criminal background check as well as every two years thereafter and continuously meet the requirements of the Bureau of Criminal Identification (BCI).

ESSENTIAL FUNCTIONS

The following duties and responsibilities are intended to be representative of the work performed by the incumbent(s) in this position and are not all-inclusive. Applicants must be prepared to demonstrate the ability to perform the essential functions of the job with or without a reasonable accommodation. Receives incoming claims, makes personal contact with the injured employee or claiming party, and sets appropriate reserves. Verifies accuracy of information in claim documents to ensure sufficient detail such as dates, times, and the description of incident. Investigates claims to verify County involvement and assess County liability. Determines compensability or liability by applying the applicable facts to the governing laws and rules. Determines Medicare eligibility and prepares file documentation for mandatory reporting. Manages claim files including preparing proper documentation, processing required benefits, negotiating settlements, and facilitates communication between all involved parties. Determines the need for and authorizes independent medical examination(s). Coordinates with physicians in scheduling and documenting medical examinations. Determines appropriateness of and authorizes diagnostic studies, surgeries, etc., and assesses and coordinates vocational rehabilitation and/or retraining when necessary. Calculates compensation amount for impairment ratings when given by the treating physician, obtains claimant's signature, and forwards to Labor Commission for approval. Reviews physician medical invoices to ascertain reasonableness and applicability of charges. Where applicable, coordinates with the Medicare Coordination of Benefits Contractor on the payment of benefits and establishes an accepted Medicare Set-Aside for claims that reach settlement. Negotiates claims settlements and makes recommendations regarding litigation. Reviews submissions for compliance with workers' compensation requirements; remains in regular communication with claimant(s) regarding claim(s) status. Attends mediation at the Labor Commission and negotiates settlements in order to avoid formal proceedings where appropriate. Works with litigation attorney(s) and attends in hearings before the Utah Labor Commission. Determines claims appropriate for subrogation and pursues at-fault parties for damages and injuries to County employees and assets.

WORKING CONDITIONS AND PHYSICAL REQUIREMENTS

Work duties are typically performed in a general office setting. May work outside in all types of weather conditions.
